Why India's Sporting Institutions must embrace legal reform to protect athlete rights

Although the Arbitration and Conciliation Act provides a framework, the absence of dedicated sports tribunals leads to procedural delays.

Time is the most precious resource in an athlete’s life. A wrongful suspension, delayed eligibility decision, or unresolved contractual dispute can permanently derail a career. Justice delayed in sport is not merely justice denied - it is opportunity extinguished.

India urgently needs fast-track, independent, and technically competent sports adjudicatory bodies.

Anti Doping: Between Integrity and Fairness

As India’s international presence grows, so do doping controversies. Compliance with the World Anti-Doping Agency (WADA) Code is essential for credibility. However, anti-doping enforcement must balance strict liability with procedural fairness.

Doping cases often involve complex scientific evidence, laboratory standards, and procedural compliance. Athletes-many from modest backgrounds-frequently lack specialised legal assistance. The discourse must shift from mere punishment to procedural justice.

Integrity in sport cannot come at the cost of natural justice.

Commercialisation and Athlete Autonomy

Modern sport is deeply commercial. Broadcasting rights, sponsorship deals, licensing agreements, and image rights shape the economics of competition. Yet Indian athletes often sign contracts without informed negotiation or adequate legal review.

As leagues expand and private capital flows into sports, legal literacy among athletes becomes indispensable. Athlete representation must evolve into a professionalised domain, combining legal acumen with sporting insight.

The era of informal understanding is over; sport today demands contractual precision.

The Case for National Sports Law

India does not merely need administrative reforms; it needs legislative clarity. A comprehensive National Sports Law should: Define the legal status and accountability of sports federations.

Establish independent dispute resolution mechanisms.

Protect athlete rights through enforceable standards.

Ensure transparency in selection, funding, and governance.Harmonise domestic regulations with international sporting norms.Such legislation would not centralise control but institutionalise accountability.

A Moment of Opportunity

India aspires to host global tournaments, increase Olympic medal tallies, and position itself as a sporting superpower. Infrastructure and talent are essential-but without legal certainty, governance stability, and institutional credibility, ambition alone will not suffice.

The growth of sports law as a specialised practice area is not merely a professional opportunity for lawyers; it is a structural necessity for Indian sport.

Sporting glory cannot rest on unstable governance.

If India wants medals with dignity, it must build law with integrity.
