US Cancels H-1B Visas of 3 Indian Workers at Abu Dhabi

Three Indians working in the US on H-1B visas were stopped from entering the US at Abu Dhabi airport. US officials also cancelled their H-1B visas. These people had spent more time in India than the permitted time.

Stayed in India Too Long

Three months or so had passed since one of the labourers arrived in India, and the other two had been there for even longer. Although they showed emergency documents and letters from their employers explaining why they stayed longer, the US officers still did not let them enter the country.

Shared Experience on Social Media

One of the affected workers shared their story online, which is now going viral. The person said they had a tough time with US immigration officers at Abu Dhabi airport. All 3 of them had their H-1B visas cancelled. The officers put a cancellation stamp on their passports under rule “41.122(h)(3)” and sent them back to India.

Emergency Proof Not Accepted

Even though the workers had approval emails from their companies and documents showing they had an emergency, the US officials at Abu Dhabi still cancelled their visas.

Why Abu Dhabi Airport is Strict

Abu Dhabi airport has a US immigration check called a “preclearance facility.” This means passengers go through US immigration and customs before they board their flight to the US. Because of this system, the checks are very strict, and some people may be stopped before they even get on the plane.

An H-1B visa lets US companies hire skilled workers from other countries for jobs in fields like IT, engineering, medicine, and business. The visa is sponsored by the company, and it usually lasts for up to six years. It can be extended if needed.

H-1B visa holders are advised not to stay outside the US for more than 30 to 40 days. Although 60 days is the maximum allowed with a valid reason, staying longer can lead to problems like visa cancellation or being denied entry.
