What is the time limit for swearing-in?
The Indian Constitution does not stipulate a specific time limit for elected representatives or Chief Ministers to take the oath of office. This process is usually completed as soon as possible after the election results are declared, but there is no fixed number of days for this.
In most states, the swearing-in ceremony takes place within three to ten days of the results, depending on how quickly the majority party or coalition stakes claim to form the government.
What is the entire process?
This process begins after the Election Commission of India declares the final results. After the vote count is complete, the Election Commission formally notifies the respective state assembly or parliament of the winning candidates. During this stage, the winning candidate is called the elected MLA or MP.
The party or coalition that secures a clear majority in the Legislative Assembly submits its claim to the Governor or President. If no party secures a clear majority, the Governor or President may invite the largest party or coalition claiming a majority to form the government. This claim must be accompanied by letters of support from MLAs or MPs to ensure that the proposed government can survive a vote of confidence.
When the Governor or President is satisfied that a party or coalition has an absolute majority, they invite its leader to form the government. At the Centre, this invitation is extended by the President of India to the leader who will become the Prime Minister, and in the states, the Governors invite potential Chief Ministers.
Before this swearing-in ceremony, the elected members of the winning party or coalition meet to formally elect their leader. This meeting determines who will be the Prime Minister at the Centre or the Chief Minister in the state. The leader then submits a list of their supporting members to the Governor or President. Once the leader is confirmed, they begin selecting their Council of Ministers. According to the Constitution, no more than 15% of the total members of the legislature can be appointed ministers.
